If you use any JustBobble Service, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use the JustBobble Services only with involvement of a parent or guardian. JustBobble reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.

Your Information

You warrant that your Submissions, in whole or in part, are clear and free of any IP right infringement, disputes or third party claims. JustBobble assumes no liability for any misuse of copyright or any other rights of third parties by you. You undertake to defense for and indemnify the Sponsor against any losses caused due to the use of the entries for any purposes.

In addition to the rights applicable to any Submission, when you post comments or reviews to the JustBobble Services, you also grant JustBobble the right to use the name that you submit with any review, comment, or other Content, if any, in connection with such review, comment, or other content. You represent and warrant that you own or otherwise control all of the rights to the reviews, comments, and other Content that you post in the JustBobble Services and that use of your reviews, comments, or other Content by JustBobble will not infringe upon or violate the rights of any third party. JustBobble, JustBobble.com, and other JustBobble graphics, logos, page headers, button icons, scripts, and service names included in or made available through any JustBobble Service are trademarks or trade dress of JustBobble in the U.S. and other countries. JustBobble’s trademarks and trade dress may not be used in connection with any product or service that is not JustBobble’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits JustBobble. All other trademarks not owned by JustBobble that appear in any JustBobble Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by JustBobble.

JustBobble respects the intellectual property of others. It is the policy of JustBobble to take appropriate action where necessary to uphold and recognize all relevant P.R.China and International laws in connection with material that is claimed to be infringing any trademark, copyright, patent and all or any other Intellectual Property laws. Orders

Pricing in Different Currencies

Pricing of products sold by JustBobble Services is based upon figures calculated in U.S. Dollars (US$). Prices displayed in other currencies are converted from U.S. Dollars according to the most up to date conversion rates. Due to fluctuating currency values, prices displayed in non-U.S. denominations of currency in the JustBobble Services, other than on the individual product page, may not be the most current. The price displayed on an individual product page, regardless of currency denomination, is the current price you are liable to pay to JustBobble, excluding shipping.

Delivery

JustBobble does not assume any responsibility of late delivery if the order is delayed or undeliverable due to the below reasons:

• No one is there to sign for the receipt of the product when it is delivered to the assigned address;

• Change of circumstance;

• Force majeure.

Risk of Loss

All products purchased from JustBobble Services are made pursuant to a shipment contract. This means that the risk of loss and title for such products pass to you upon our delivery to the carrier.

Returns, Refund and Title

JustBobble does not take title to returned products until the product arrives at our designated fulfillment center. At our discretion, a refund may be issued without requiring a return. Disputes

The execution, effectiveness, construction, performance, amendment and termination of these Terms and the resolution of disputes hereunder shall be governed by the laws of P.R.China. Any dispute or claim relating in any way to your use of any JustBobble Service, or to any products or services navigated by JustBobble or through the Websites will be resolved by binding arbitration, rather than in court. Any Party may submit the relevant dispute to the Shanghai International Arbitration Center for arbitration, in accordance with its then-effective arbitration rules. The arbitration shall be conducted in Shanghai, and the language used during arbitration shall be English. The arbitration ruling shall be final and binding on both Parties.

Remedies

You agree that JustBobble 's remedy at law for any actual or threatened breach of this Terms of Use would be inadequate and that JustBobble shall be entitled to specific performance or injunctive relief, or both, in addition to any damages that JustBobble may be legally entitled to recover, together with reasonable expenses of any form of dispute resolution, including, without limitation, attorneys' fees.

No right or remedy of JustBobble shall be exclusive of any other, whether at law or in equity, including, without limitation, damages injunctive relief, attorneys' fees and expenses.

No instance of waiver by JustBobble of its rights or remedies under these terms and conditions shall imply any obligation to grant any similar, future or other waiver.
